Two Fingers to the Four Fingered KitKat

I blogged some time back about a long running and very expensive legal dispute between Nestle and Cadbury Schweppes, now owned by Mondelez International. The European Union Intellectual Property Office has finally ruled that the Kit Kat four finger trade mark is invalid, based on a need for it to be considered “distinctive” in all EU Member States. And it’s only taken from 2007 to come to a final decision!

Apparently the legal argument has only been around the four finger packs, and thinking about it there are lots of supermarket own brand Kit Kat copies, but only ever packed as two fingers not four. Well I expect four fingers to pop up in lots of other products sometime in 2017 so it’s not just two fingers to Nestle!
